Official: Man's NYC arrest in Lohan dispute voided

NEW YORK (AP) ? A 25-year-old man initially arrested Sunday on an assault charge after Lindsay Lohan claimed he grabbed her in her New York hotel room in an argument over cellphone images was freed hours later and his arrest voided when the charge could not be substantiated, law enforcement officials said.

Instead, Christian LaBella of Valley Village, Calif., and Lohan filed harassment complaints with police against each other after they were interviewed by police about their run-in, law enforcement officials said.

Afterward, Lohan publicist Steve Honig expressed outrage that police did not charge LaBella.

"We think it's both distressing and outrageous," he said in a telephone interview. "Lindsey was assaulted and there needs to be a consequence for that."

LaBella could not be reached for comment.

LaBella was taken into custody about 6 a.m. after a 911 call came from the swank W Hotel in Manhattan's Union Square where Lohan apparently pulled the fire alarm, the two officials said. The officials were not authorized to speak publicly and spoke to The Associated Press on condition of anonymity.

A former congressional aide, LaBella was arrested on a misdemeanor assault charge but released later Sunday. The charge could not be substantiated so the arrest will be voided, the officials said.

The paperwork was being completed on cross-harassment complaints, which are considered a violation, and no other legal action would be taken, the officials said.

Lohan and LaBella met hours earlier at a night club, though it was unclear whether they previously knew each other, the officials said. They went back to her room, when she noticed the cellphone photos of her on his phone and grabbed the device, the officials said.

She claimed LaBella grabbed her and threw her, but later he said she had forcefully taken his phone, the officials said. Lohan was injured but not hospitalized, Honig said in a statement.

"Lindsay has spoken with police and is fully cooperating with the investigation," he said after LaBella's arrest.

This is Lohan's second run-in with law enforcement in as many weeks in New York City. The 26-year-old was accused last week of clipping a pedestrian with her car outside a nightclub and driving away. She was given a ticket and was scheduled to appear in court Oct. 23. Honig has said he expects those allegations to be proven false.

The actress was also involved in a car accident in California this summer that sent her and an assistant to a hospital, but didn't result in serious injuries for anyone. The accident remains under investigation.

In May, she was cleared of allegations that she struck a Hollywood nightclub manager with her car.

Lohan remains on informal probation for taking a necklace from a jewelry store without permission last year. That means she doesn't have to check in with a judge or probation officer but could face a jail term if arrested again.

Lohan recently filmed "The Canyons," an indie film written by "Less Than Zero" and "American Psycho" author Bret Easton Ellis.

Steve Tomaszewski, a spokesman for Illinois Rep. John Shimkus, confirmed Sunday afternoon that LaBella has worked for the congressman in his Washington office. Tomaszewski said no one from the Republican's office had been contacted by LaBella.

An English man has been arrested on suspicion of child abduction after he was found in France with a 15-year-old high school student, police said Friday.

A statement on the Sussex Police website said Megan Stammers and Jeremy Forrest, a 30-year-old math teacher, were found ?safe and well? at 1:15 p.m. local time in France (7:15 a.m. ET).

?Mr Forrest has been arrested on suspicion of child abduction and Megan has been taken into protection,? the statement said. ?Their families have been informed and arrangements will now be made for Megan and Jeremy's safe return.?

In an interview with ITV News, Martin Stammers said he was ?thrilled, delighted, overjoyed.?

?The most amazing thing at the moment,? he said, touching his chest, ?is the joy in here that she?s safe and well ? you cannot describe the relief.?

Police: UK teen thought to have run away to France with her math teacher

Stammers praised police and also people using social media sites to raise awareness about his daughter.

Megan?s sister Brooke Stammers expressed her joy at the news?in several messages on Twitter.

?Absolutely on top of the world of the world right now, to know our Megan is safe and sound! Love you so much my beautiful sister xxxxxx,? she said in one.


?All our hope and faith came through so strong and our positivity stuck out!? she added.

Before they were found,?Forrest?s father Jim had made an emotional appeal for Forrest or Megan to get in touch, ITV News reported.

?There are a lot of people back home who are desperate to hear from you. All I?m asking is for one of you to make a call or send an email to let us know that you are both safe,? he said. ?We are all ? we are all here for you both. We just need to hear from you.?

Virginia Medicaid rules confuse cancer patient | WTVR.com ...

VIRGINIA BEACH, Va. (WTKR) ? Imagine being told, ?We help cancer patients, but just not you.? One Virginia Beach woman came to NewsChannel 3 for help after she said she was told her cancer wasn?t good enough.

?I know if I don?t get treatment, I?m not going to live, I?m not going to have a chance,? said cancer patient Vicki Andrus.

Living through cancer once is tough enough, but after seven years in remission, Vicki Andrus found out she would have to fight lung cancer for a second time.

?Came back, there was a tumor in the exact same location as other tumor, with the exact same cancer.?

So the merry go-round started again including visits to her oncologist, her radiologist, and her surgeon ordering CAT-scans, PET-scans and lung scans. That ended in the decision by doctors to remove her entire right lung.

?I left and my head was totally spinning thinking about all the if?s and buts.?

Including how she was going to pay for it all, because in her job as a teaching assistant, Vicki doesn?t get the benefit of health insurance.

?All my time and energy is not able to be spent on what?s happening to me,? she says. Right now my energy is only spent on all these overwhelming medical bills.?

With $30,000 already racked up before a single round of chemotherapy or surgery, Vicki decided to go to the State of Virginia for help, hoping she would be eligible for Medicaid.

A family member first contacted the city of Suffolk?s social services office. In an online response, an employee said she could apply but that ?the only medical category for cancer is breast and cervical cancer.?

?Breast cancer and cervical cancer would be a qualifier for Medicaid. How dare they discriminate against all the other cancers there are.?

?Cancer is cancer. I don?t care what kind you have, I don?t care what stage it?s in, and it doesn?t matter.?

Just to make sure, Vicki called her local Medicaid office in Virginia Beach and got the same answer.

Again, they told her to apply anyway, but Vicki felt discouraged that her cancer wasn?t good enough for coverage.

?You can?t just pick and choose, this one has breast cancer, we?ll take her, this one has ovarian cancer, no, she?s not going to qualify.?

?I really want to know why, get an answer from the State of Virginia about why they can pick and choose?

So Vicki asked NewsChannel 3 to take action.

And the first place we went was the state?s department of social services, which administers Medicaid.

They do admit that ?breast cancer or cervical cancer is specifically designated as a qualifying medical condition for Medicaid under the breast and cervical cancer treatment act.?

But even in that special program, women still have to be considered low-income to get help.

According to the state, if you qualify for full Medicaid coverage, cancer treatments are always paid for, no matter what type of cancer you have.

So why wasn?t this explained to Vicki by her local office?

According to the city of Virginia Beach, ?state Medicaid policy allows local social service agencies to provide general information only.?

They showed NewsChannel 3 a directive which says local offices should ?limit verbal and written information?? because ?an attempt to be helpful could be futile or lead to incorrect advice.?

It seems the local offices went against that very rule in their conversations with Vicki, giving her more information than she needed about breast and cervical cancer, and confusing her in the process.

But the state wouldn?t say if Virginia Beach or Suffolk violated social services policy.

In the end, NewsChannel 3 found out that the state was not discriminating against Vicki?s lung cancer, but their answers haven?t helped her get any closer to possible coverage.

Vicki applied for Medicaid three weeks ago, and has yet to hear back on whether she qualifies under their disabled category.

?Whatever it takes, I will fight for whatever treatment I can have, because I?m not going to give up.?

?I plan on being around for a long time. I have a lot of grandchildren that I want to see grow up, be a part of their lives.?

Vicki just underwent that surgery to remove the remaining lobes of her right lung.

She is doing well, still recovering at Sentara Norfolk Heart Hospital.

And while she is waiting on an answer for Medicaid eligibility, Sentara has told us that Vicki will receive assistance with her medical bills through their uninsured patient discount program.

It?s available to anyone without insurance, all you need to do is ask.

Netanyahu's 'red line' mocked on Twitter

During his speech before the United Nations General Assembly on Thursday, Israeli Prime Minister Benjamin Netanyahu warned that the completion of Iran's nuclear enrichment program threatens the stability of the Middle East, Europe and the United States?and urged world leaders to draw a "red line" to prevent Iran from continuing on.

In a highly unusual move, Netanyahu wielded a prop to illustrate his point: He literally drew a red line across a poster that showed a cartoon of a bomb.

"Iran is 70 percent of the way there and ... well into the second stage," Netanyahu said while displaying the chart. "By next summer, at current enrichment rates, they will have finished the medium enrichment and moved on to the final stage. From there it is only a few more weeks before they have enriched enough for a bomb.

"Each day, that point is getting closer," he warned.

As you might expect, a few Twitter users mocked the display.

"Okay, it's official," The Atlantic's Jeffrey Goldberg wrote. "Netanyahu has no idea what he's doing. He has just turned a serious issue into a joke."

Goldberg continued: "Netanyahu's bomb cartoon is the Middle East equivalent of Clint Eastwood's chair."

"Apparently Netanyahu took a chart-making course from Paul Ryan," the comedian Rob Delaney tweeted.

"I didn't realize nuclear bombs looked like the bombs from Super Mario," Buzzfeed's Andrew Kaczynski quipped.

"Netanyahu has reduced nuclear war diplomacy to cartoons and markers," Sam Stein tweeted.

Many Twitter users questioned the wisdom of bringing clip art to the U.N., while some referenced a Roadrunner comparison.

"Excuse me, Prime Minister Netanyahu?" Rex Huppke wrote. "Wile E. Coyote called. He wants his bomb back."

"From what I can tell," ? @AGFlores tweeted, "Iran is seeking 1950's cartoon bombs made by Acme."

Biologists uncover dynamic between biological clock and neuronal activity

ScienceDaily (Sep. 25, 2012) ? Biologists at New York University have uncovered one way that biological clocks control neuronal activity -- a discovery that sheds new light on sleep-wake cycles and offers potential new directions for research into therapies to address sleep disorders and jetlag.

"The findings answer a significant question -- how biological clocks drive the activity of clock neurons, which, in turn, regulate behavioral rhythms," explained Justin Blau, an associate professor in NYU's Department of Biology and the study's senior author.

Their findings appear in the Journal of Biological Rhythms.

Scientists have known that our biological clocks control neuronal activity. But not previously understood is how this process occurs -- that is, how does information from biological clocks drive rhythms in the electrical activity of pacemaker neurons that, in turn, drives daily rhythms?

To understand this mechanism, the researchers examined the biological, or circadian, clocks of Drosophila fruit flies, which are commonly used for research in this area. Earlier studies of "clock genes" in fruit flies allowed the identification of similarly functioning genes in humans.

In their study, the researchers focused on eight master pacemaker neurons located in the central brain -- these neurons set the timing of the daily transitions between sleep and wake in the fly. Specifically, they were able to isolate these neurons from animals and identify sets of genes differentially expressed between dawn and dusk.

In a series of follow-up experiments, they concentrated on one gene, Ir, whose expression was found to be much higher at dusk than at dawn and much more highly expressed in pacemaker neurons than in the rest of the brain. Ir encodes a potassium channel that helps set the resting state of neurons -- and so its rhythmic expression makes it an excellent candidate to help link the biological clock to pacemaker neuron activity. High levels of Ir expression at dusk should make it much harder for pacemaker neurons to signal than the low levels seen at dawn, a finding that fits with earlier studies showing that pacemaker neurons fire more at dawn than at dusk.

The authors also found that genetic manipulations that either increase or decrease Ir levels affect behavioral rhythms. Perhaps more interestingly, these were also associated with changes in the timing and strength of oscillations in the core clock.

"Biology is never as simple as we imagine it will be," explained Blau. "We were looking for an output of the biological clock that would link the core clock to neuronal activity. Ir seems to do this, but it also, remarkably, feeds back to regulate the core clock itself. Feedback loops seem to be deeply engrained into the biological clock and presumably help these clocks work so well."

The study's other co-authors were: Marc Ruben, a doctoral candidate; Mark Drapeau, a former postdoctoral researcher; and Dogukan Mizrak, a doctoral candidate. The study was funded by grants from the National Institutes of Health.

Poll deals climate change blow for Mitt Romney

More bad news for Mitt Romney: the Republican party's scepticism about climate change seems likely to play badly with voters who haven't yet decided who to back in November's US presidential election.

A new poll, run by Yale University and George Mason University in Virginia, has found that, when it comes to their views on climate change, "undecideds" look remarkably similar to supporters of Barack Obama.

Of the 1061 people polled, about three-quarters are judged likely to vote, based on their registration, stated intentions and past turnout. Among them, just 27 per cent of Romney backers believed global warming was human-caused, compared to 65 per cent of the Obama supporters.

Of the 87 undecideds who were likely voters in the sample, 65 per cent believed global warming was human-caused, and 61 per cent said the issue would help guide their vote.

Because the sample contained just 87 undecideds who were likely to vote, there is a large margin of error surrounding these numbers. Still, the difference between undecideds and Romney supporters was statistically significant.

"We'd have expected them to be somewhere in the middle," says Anthony Leiserowitz, who heads the Yale Project on Climate Change Communication. "But we find they're very similar to likely Obama voters."

Consistent results

The results are broadly consistent with a study released in December 2011, in which a team led by Jon Krosnick of Stanford University in California presented statements by hypothetical political candidates, and asked people whether these candidates would win their support.

This suggested that Republicans, in particular, are likely to gain votes by taking "green" positions, and lose votes by expressing scepticism about climate change.

So why has the Republican party largely embraced climate scepticism? Krosnick speculates that it is due to the influence of wealthy donors who oppose action to limit climate change. Still, he doubts whether the votes gained through spending on campaign ads will counter those lost by taking a sceptical position.

While Romney has acknowledged that human activities are contributing to climate change, he cites "a lack of scientific consensus" on the issue, and in accepting the Republican nomination mocked Obama's efforts to "begin to slow the rise of the oceans and heal the planet".

Leiserowitz doesn't expect climate change to be a key issue in the election, but with the polls slipping away from Romney, the Republican candidate will need every vote he can get.

"Homeland" triumphs as Emmys go for dose of reality

LOS ANGELES (Reuters) - "Homeland" toppled "Mad Men" to win the top drama prize on Sunday as the Primetime Emmy awards favored politics and 21st century tensions over shows set in bygone eras.

"Modern Family," ABC's show about the chaotic lives of three related couples and their children, won best comedy series for a third year and supporting actor Emmys for Eric Stonestreet and Julie Bowen, as well as a directing award.

"I am praying that everyone doesn't get sick of us," joked executive producer Steve Levitan.

Backstage, Stonestreet joked, "We know that eventually it will not be this way and you will hate us all."

"Homeland," a post 9/11 psychological thriller about a returning Iraq war hero turned by al Qaeda, won best drama after one season on cable channel Showtime. It also took home trophies for best writing and best acting for its two leads, Claire Danes and Damian Lewis, for a total of six including technical awards.

"Homeland," said to be one of President Barack Obama's favorite TV programs, brought to an end the reign of AMC's stylish 1960s advertising show "Mad Men," which left Sunday's Emmy ceremony empty-handed.

It was the biggest shutout in Emmy history for "Mad Men," which had gone into Sunday's awards as joint top nominee with 17 nominations.

"Homeland" also beat popular "Downton Abbey," about aristocrats and their servants in an English country house, and HBO's medieval fantasy series "Game of Thrones," in what was the first year that all the nominated best drama series came from cable television.

AGE OF ANXIETY

Danes, who plays a bipolar CIA operative in a cat-and-mouse game with Lewis's sleeper agent, said she believed "Homeland" had succeeded with viewers and critics because it was neither preachy nor overtly political.

"We are a little startled. I don't think anyone was expecting to be recognized this way starting off," Danes told reporters backstage.

(The show) "doesn't take a very biased position (but) it does speak to our feelings of anxiety and unrest right now, in the sense that we're in a new era where the enemy is not so clear."

Danes said it was "way cool" that Obama is a fan. "I think it speaks to the relevancy of the show, and it's hugely validating," she added.

"Homeland" returns for a second season on September 30, with an opening episode set against the fictional bombing by Israel of Iranian nuclear facilities and the global tensions that ensue.

American politics did figure strongly in other Emmy races. "Game Change," the HBO story of Sarah Palin's entry into the 2008 U.S. vice presidential race, was also a big winner, taking the Emmy for best miniseries, writing, directing and acting for star Julianne Moore.

"Wow, I feel so validated because Sarah Palin gave me a big thumbs down!" Moore said while accepting her first Emmy.

Backstage Moore thanked actress and Palin impersonator Tina Fey, and journalist Katie Couric for what she called their "incredible influence" on the 2008 elections. Couric interviewed Palin in 2008 in what became a cultural and political landmark after the encounter was spoofed by Fey on "Saturday Night Live."

In what was seen as a tight race for lead comedy actress, Julia Louis-Dreyfus beat "Girls" star Lena Dunham, Amy Poehler, "New Girl" Zooey Deschanel and Tina Fey with her turn as a frustrated U.S. vice president in the wickedly satirical HBO political show "Veep."

"It's a bit mystifying to me because people say this show is a comedy, but I don't see anything funny about me being vice president of the United States," the former "Seinfeld" star quipped.

POLITICAL JOKES

With the presidential elections less than two months away, Emmy show host Jimmy Kimmel got the festivities off to a biting and topical start in an opening monologue.

Kimmel joked that U.S. television was "the only American product the Chinese haven't figured out how to make."

As for the sprawling grandeur of "Downton Abbey," which is set in an aristocratic country house at the beginning of the 20th century, Kimmel quipped, "It really gives you a sense of what it must have been like to grow up in (U.S. Republican presidential candidate) Mitt Romney's house."

"Two and A Half Men's" Jon Cryer was the surprise winner in the comedy actor category, beating fellow CBS nominee and double Emmy winner Jim Parsons of geeky show "The Big Bang Theory."

Stand-up comedian Louis C.K. went home with his first two Emmys - one for writing for his FX show "Louie", in which he also stars as a divorced dad, and another for directing his own TV stand-up special.

Oscar-winning actor Kevin Costner won an Emmy in his first role for television. Costner starred in the popular History channel miniseries "Hatfields & McCoys," about a legendary feud between two 19th century families, while Tom Berenger took a supporting actor Emmy for his role in the show.

"I'm a writer-orientated actor and when I find the writing, I don't care what medium it sits," Costner told reporters on Sunday of his move to television.

"The Amazing Race" won for the best reality series Emmy for the ninth time, while Tom Bergeron won best reality host for "Dancing with the Stars."

Rob Lederer Resigns as Executive Vice President of NPMA

Lederer has left his position as executive vice president of the National Pest Management Association, effective immediately.

The announcement was made by NPMA President Laura SImpson during an NPMA Board of Directors conference call this morning. Lederer will remain with NPMA for six months in a consulting role.

In an NPMA press release, Lederer stated, "I treasure my NPMA experiences, particularly the many people I've had the opportunity to meet and what I've learned over the years. But, many of us who travel intense career paths reach a point where it is time to pursue new challenges, and, now, that time has come.?

Simpson praised Lederer's contributions to the association and the industry, saying he is largely responsible for building NPMA into a powerhouse organization. "Rob leaves behind an incredibly solid association made up of individual building blocks he stacked with precision and intent. From the strength of partnerships with our state associations to the creation of Quality Pro and the Professional Pest Management Alliance, from the fostering of new industry leaders at Academy and Leadership Development Group to our widely respected government affairs program, the industry owes Rob a resounding thanks for his far reaching efforts that will outlive his time with the association."

Simpson noted NPMA's executive committee has begun diligent work on a transition plan and that members can be assured the association's activities will continue to operate fully during the search for and transition to a new executive vice president. "The great work of NPMA staff, our board and the existing programs established during Rob's tenure as our leader will continue unvarnished while we undergo a comprehensive, national search for the right candidate," Simpson expressed. "We don't enter into this search lightly and won't make decisions without careful, consideration for the day-to-day operations and long-term strategic goals of the organization."

As tensions grow over island dispute, Chinese navy receives first aircraft carrier

China?s first aircraft carrier was handed over Sunday to the navy of the People?s Liberation Army, state press said, amid rising tensions over disputed waters in the East and South China Seas.

The handover ceremony of the 300-metre ship, a former Soviet carrier called the Varyag, took place in northeast China?s port of Dalian after a lengthy refitting by a Chinese shipbuilder, the Global Times reported.

A ceremony to place the ship into active service would be held sometime in the future, the paper said without elaboration.

China on Sunday also postponed a ceremony marking the 40th anniversary of the establishment of diplomatic ties with Japan, due to a noisy territorial dispute with Tokyo over the Diaoyu Islands, known in Japanese as Senkaku.

Tensions have also risen this year with Vietnam and the Philippines over disputed islands in the South China Sea.

Beijing confirmed last year it was revamping the old Soviet ship, and has repeatedly insisted the carrier poses no threat to its neighbours and will be used mainly for training and research purposes.

But numerous sea trials of the aircraft carrier - currently only known as ?Number 16? - since August, 2011 were met with concern from regional powers including Japan and the United States, which called on Beijing to explain why it needed an aircraft carrier.

Relations have sunk to their worst level in years as China and Japan spar over the islands in the East China Sea claimed by both countries and by Taiwan.

In the latest large anti-Japan protest in China, up to 3,000 people demonstrated Sunday in the southern city of Guangzhou, Xinhua reported.

Chinese Foreign Ministry spokesman Hong Lei said in a statement late Saturday that Japanese personnel had landed on the islands to stop Taiwanese activists from doing so, and China had protested strongly to Japan over the ?severe infringement upon China?s territorial sovereignty.?

A group of Taiwanese fishermen have said they will sail 60 boats to the islands on Monday to protect their fishing grounds.

Hundreds of people marched in Taiwan?s capital, Taipei, on Sunday to protest against Japan for occupying the islands.

Japan?s government purchased several of the islands from their private Japanese owners this month, setting off angry demonstrations across China.

Taiwan?s government has maintained a cautious approach to the dispute to avoid straining ties with Japan.
